How Is Liability Determined in a Pedestrian Accident in Horry County, SC?

Liability in a South Carolina pedestrian accident is determined by examining whether the driver, the pedestrian, or another party failed to exercise reasonable care under the circumstances.

To determine how the accident occurred, investigators may review the official crash report, witness statements, surveillance footage, photographs, vehicle damage, and roadway conditions.

Authorities may also evaluate visibility, lighting, traffic control devices, speed, and the actions of everyone involved immediately before the collision. Together, this evidence helps investigators develop a more complete understanding of the events leading up to the crash.

When a pedestrian suffers serious or fatal injuries, preserving documentation can be an important part of the claims process. Medical records, emergency response reports, funeral expenses, insurance correspondence, and documentation of financial losses may all help establish the impact of the collision.

Maintaining organized records can also help support insurance claims or potential wrongful death actions as the investigation progresses.

A wrongful death attorney familiar with South Carolina law can help review the available evidence, communicate with insurance companies, and explain what legal options may be available based on the circumstances of the case. Legal guidance may also clarify how South Carolina's comparative negligence laws may apply, what insurance coverage could be available, and what compensation may potentially be pursued if supported by the evidence.
