What Can a Family Recover After a Fatal Head-On Crash in Clemson, SC?

When a person is killed in a head-on collision in Clemson, surviving family members may be able to recover compensation through a wrongful death claim under South Carolina law. Establishing how this particular crash occurred, including which vehicle may have left its lane of travel and what factors contributed to the collision, will be central to determining liability.

South Carolina follows a modified comparative fault system, which allows responsibility to be divided among multiple parties if more than one driver's actions contributed to the crash, though compensation can still be pursued as long as the deceased is not found to be more than fifty percent at fault.

If the circumstances are given, gathering evidence of the crash, including any available witness accounts, the official police report, and the findings of the ongoing coroner's investigation, will be important in establishing a clear understanding of how the collision occurred and who may bear responsibility.

In a South Carolina wrongful death lawsuit, surviving family members may be able to recover monetary damages for burial and funeral expenses, the loss of the deceased's future earning potential and income, and the ongoing loss of support and companionship.

A wrongful death lawyer might be able to assist a family in gathering proof of how the collision happened, navigating South Carolina's comparative fault laws, and making sure that any settlement reached accurately represents their legal losses.
