What Happens When a Loved One Dies in a Car Accident in Beaufort?

The loss of a loved one in a crash in Beaufort is a life-changing experience, and it’s natural to wonder what comes after such a tragic event. In Beaufort, South Carolina, the law allows certain family members to file a wrongful death claim when a person dies due to the negligence or wrongful actions of another.

This type of lawsuit is designed to hold responsible parties accountable and may provide compensation for losses related to the death, such as medical expenses, funeral costs, lost financial support, and the emotional impact of losing a loved one.

South Carolina law defines who can bring a wrongful death claim. Generally, the surviving spouse, children, or parents of the deceased may file a lawsuit. Other family members typically cannot file unless specific conditions are met under state law.

The claim is filed against the person or entity whose negligence caused the fatal crash, which could include drivers, vehicle owners, or sometimes companies responsible for vehicle maintenance.

It’s important to know that South Carolina sets deadlines for filing wrongful death claims. In most cases, a lawsuit must be filed within three years from the date of death, though there may be exceptions depending on circumstances.

A consultation with an experienced personal injury or wrongful death attorney can help you understand your legal rights, identify the proper defendants, and ensure your claim is filed correctly and on time.
