In many estate cases, a will names the personal representative. If the deceased person did not select one, the probate court may appoint someone to manage the estate and bring the claim for the family. That person acts on behalf of the estate and carries out all legal duties related to the claim.
Under South Carolina law, wrongful death proceeds generally pass to the deceased person’s legal heirs. Depending on the family structure, this may include a spouse, children, parents, or other eligible heirs. Each family’s circumstances determine how the recovery is distributed.
A wrongful death claim may seek compensation for funeral expenses, lost financial support, and loss of companionship. The available amount depends on the person’s circumstances and the evidence supporting each loss.
During an already difficult time, identifying the proper person to file can be challenging. A wrongful death attorney can preserve evidence, document the family’s losses, and communicate with the insurance company.
