Who Can File a Wrongful Death Claim in Greer, SC?

Crash Kills One, Hurts Another on S Hwy 14 In Greer and throughout South Carolina, the executor or administrator of the deceased person’s estate files a wrongful death claim on behalf of the family. Individual relatives generally do not file separate wrongful death claims on their own.

When compensation is recovered, it generally benefits the surviving spouse and children first. If there is no surviving spouse or child, the parents may receive the recovery, followed by other heirs when no closer relatives survive.

If the deceased person left a will, it may name the person who will serve as executor. When there is no will or no qualified executor, the probate court can appoint an administrator to handle the estate.

After a wrongful death claim is filed, compensation may include funeral expenses, lost financial support, grief, and loss of companionship. The amount available depends on the family’s circumstances and the losses connected to the death.

South Carolina also allows a separate survival claim in some cases. Through that claim, the estate may seek compensation for losses the person experienced before death, including medical expenses and conscious pain and suffering.

Families generally have three years to bring a wrongful death lawsuit in South Carolina. Missing this deadline may prevent the family from recovering compensation, so keeping track of the filing period is important.

Because filing rules can vary, a South Carolina wrongful death lawyer can explain who may file and help with the required estate and court procedures. An attorney can also identify the losses that may be included in the claim.
