We are thinking of everyone affected by this crash.

Fault is generally proven by showing that a driver owed a duty of care, broke it, and caused the harm that followed. Evidence such as the police report, witness statements, photos, vehicle damage, camera footage, and data stored in a vehicle can support each step.
In South Carolina, the injured person usually carries the burden of proof, which means the evidence must show it is more likely than not that the other driver was at fault.
A police report is a starting point, not the final word. It records an officer's observations and may note a citation, but insurers and courts weigh it alongside other proof. An officer who arrived after the fact may not have seen what happened.
Independent witnesses usually carry more weight than the drivers, since they have no stake in the outcome, and their names and phone numbers are easy to lose if nobody writes them down.
Physical and digital evidence can fade quickly. Businesses may keep security footage for only days or weeks, and skid marks and debris disappear once a roadway is cleared. A car accident lawyer can send preservation letters, interview witnesses while their memories are fresh, and bring in an accident reconstruction specialist to explain what the physical evidence shows.
