How Do Federal Trucking Regulations Affect Liability After a Fatal Crash in York County, SC?

Driver Killed by Tractor-Trailer After Crash on I-77Commercial truck crashes involve a layer of regulation that doesn't apply to typical passenger vehicle collisions. The Federal Motor Carrier Safety Administration sets rules covering driver hours-of-service limits, vehicle maintenance standards, and drug and alcohol testing requirements, and a violation of any of these rules can become central evidence in a wrongful death claim.

Trucking companies are also required to maintain records such as driver logs, dispatch records, and maintenance histories, all of which can reveal whether fatigue, mechanical failure, or improper training played a role in a crash.

Because these records tend to be kept only for a limited time, preserving them quickly is one of the most important steps a family can take after a fatal trucking collision. Insurance carriers and trucking companies typically have investigators on scene within hours of a serious crash, which can put grieving families at a disadvantage if they wait to gather their own evidence.

A wrongful death lawyer can send preservation letters early, requiring the carrier to retain black box data, driver logs, and maintenance records before they're lost or destroyed.

At The Arndt Law Firm, we can help you understand how federal trucking regulations and multiple layers of liability may apply to your situation. We can explain what evidence matters most in a case like this.
