Does South Carolina Follow a Comparative Fault Rule for Car Accidents?

Emergency Crews Rush to Injury Crash on River RdYes, South Carolina follows a modified comparative negligence rule. This rule allows a person to recover compensation as long as they are found less than 51 percent at fault for a crash.

This means a driver who was 20 percent at fault could still recover 80 percent of their damages, while someone found 51 percent or more at fault recovers nothing.

Insurance adjusters tend to use ambiguous intersection facts to shift blame onto the injured party, since doing so directly lowers what the insurer has to pay. Police reports, witness statements, and traffic camera footage, when available, all factor into how fault percentages get assigned.

Building the evidentiary picture is commonly where a car accident lawyer becomes useful, helping gather and organize the records needed to counter an inflated fault argument.

Our team at The Arndt Law Firm can review the details of your case and explain how South Carolina's fault rules might apply to your situation. Every case is different, and the specific facts matter.
