Can Families Pursue a Wrongful Death Claim After a Fatal Crash Caused by a Fleeing Driver?

Driver Dies After Suspect Flees and Crashes Into Another Vehicle

Yes, families may be able to pursue a wrongful death claim in South Carolina when a loved one is killed in a crash caused by a driver who allegedly fled from law enforcement or otherwise acted negligently or recklessly.

Although criminal charges may be filed against the driver, a civil wrongful death claim is a separate legal matter with a different purpose. While the criminal case focuses on determining guilt and imposing penalties, a civil claim seeks financial compensation for the surviving family members who have suffered losses because of the fatal collision.

As the investigation moves forward, evidence such as crash reports, witness statements, surveillance footage, vehicle damage, and accident reconstruction findings can play an important role in establishing how the collision occurred and the extent of the driver's responsibility. These materials may also help support any related insurance claim.

Because fatal crashes involving fleeing drivers often present complex legal and insurance issues, a wrongful death lawyer may be able to review the available evidence, explain the family's legal options, identify all potential sources of compensation, and help ensure that any claim reflects the full impact of their loss.

Our team at the Arndt Law Firm has experience reviewing wrongful death accident cases, and we can help families across South Carolina understand what evidence may support a claim.
