What Is the Statute of Limitations for a Hit-and-Run Crash in Spartanburg, SC?

Injuries Follow Hit-and-Run on Caulder Ave

People injured in a hit-and-run crash in Spartanburg, SC, generally have three years to file a personal injury lawsuit under South Carolina Code § 15-3-530(5). The statute generally applies to actions for injuries to a person or another person’s rights that do not arise from a contract.

This deadline can apply to claims involving medical expenses, lost income, vehicle damage, pain and suffering, and other losses connected to a hit-and-run accident.

When the responsible driver is initially unidentified, determining when the limitations period begins can depend on the specific facts and applicable law. South Carolina Code § 15-3-535 provides that certain personal injury actions must be commenced within three years after the person knew or, through reasonable diligence, should have known that a cause of action existed.

After a Spartanburg hit-and-run crash, injured people should preserve crash reports, medical records, photographs, witness statements, insurance information, vehicle repair records, and available surveillance or traffic-camera footage. These materials may help identify the driver and establish the circumstances of the crash.

Understanding South Carolina’s personal injury statute of limitations early can help ensure that a potential hit-and-run claim is evaluated before the applicable three-year deadline expires. Because unidentified drivers and other circumstances can create additional legal issues, the specific facts should be reviewed when determining the applicable filing deadline.

When questions arise about evidence or insurance coverage, a car accident lawyer can review the claim, communicate with insurers, and help determine what additional information may be needed.
