What Determines Fault in a Rollover Wreck in Greer, SC?

Injuries Reported After Rollover on Wade Hampton BlvdTo determine fault in a rollover usually starts with whether a driver lost control due to speed, a sudden steering correction, or a previous crash, and South Carolina's modified comparative negligence rule allows an injured person to recover damages as long as they were not 51 percent or more at fault for the crash, a threshold a car accident lawyer typically helps calculate once police reports and witness statements come in.

People hurt in rollover crashes can face injuries that differ from a typical collision, including spinal trauma, head injuries from contact with the roof, and harm caused by loose objects shifting inside the vehicle during the rollover itself.

South Carolina gives an injured person three years from the date of the crash to file a personal injury lawsuit. Preserving evidence such as police reports, medical records, or photographs from the scene can help build a strong claim.

A crash raises questions that aren't always obvious right away. Our team at The Arndt Law Firm can look into your specific case details to help you understand what your next step could be based on South Carolina law.
