There's a persistent bias in how multi-vehicle crashes that involve a motorcycle get treated, and it works against the rider from the start. Insurance adjusters and even some investigators tend to assume a motorcyclist was speeding, weaving, or otherwise at fault simply because motorcycles are smaller and less visible.
In a multi-vehicle situation, this bias becomes especially costly, since fault could rest primarily with either of the two larger vehicles that boxed in or failed to see the motorcycle.
Yet the physical damage usually looks the most severe on the motorcycle and its rider, which can create a false impression that the smaller vehicle was somehow the aggressor rather than the one struck.
South Carolina law does not treat motorcyclists differently when it comes to fault; the same modified comparative negligence rule applies, allowing a rider to recover damages as long as they're found less than 50% responsible.
Overcoming an adjuster's initial assumption usually requires more than the rider's own account. A motorcycle accident lawyer can bring in accident reconstruction specialists to analyze skid marks, vehicle positioning, and impact angles across all three vehicles, work that's especially important when a motorcyclist's version of events is competing against two drivers whose accounts may align with each other by default.
