South Carolina Statute of Limitations After a Crash in Society Hill, SC

Injuries Reported in Crash on S Main St

South Carolina law gives an injured person three years to file a personal injury lawsuit after a car crash. It may sound like plenty of time, but it is important to take some first crucial steps early on. It is important to note that the deadline runs from the date of the crash itself.

If claimants miss the deadline, South Carolina courts will dismiss the case, no matter how strong the underlying facts are or how clearly the other driver was at fault.

The three-year window also isn't just a filing deadline; it's effectively a deadline for building the case itself. Witnesses move, memories fade, and vehicle repairs erase physical evidence long before three years pass. Medical records, photographs, crash reports, insurance documents, and other evidence can also become harder to obtain as time passes.

After a crash, an injured person should seek medical attention and keep records of related treatment and expenses. It can also help to preserve photographs of injuries, vehicles, and roadway conditions when available. Insurance communications should be handled carefully, especially when the full extent of an injury is not yet known.

South Carolina's statute of limitations can also have exceptions or different deadlines in certain circumstances. Government claims, wrongful death cases, and claims involving minors may involve different rules. Because missing an applicable deadline can affect whether a lawsuit may proceed, reviewing the facts and applicable law promptly can help avoid unnecessary delays.

This is why a car accident lawyer’s early involvement matters even when the legal deadline itself still feels far off. Getting statements and records locked in early protects a claim's strength regardless of when it's ultimately filed.

At The Arndt Law Firm, we help South Carolina crash victims keep track of these deadlines while their case is still being built.
