When a person dies in a crash, eligible family members may have legal options, including a wrongful death claim, if another party may be legally responsible.
Potential claims can involve certain financial and non-economic losses, depending on the circumstances and applicable law.
One consideration is the financial support the deceased provided to their family. Records of earnings, employment, household contributions, and other financial information may help establish the economic effects of the loss. These details can be relevant when evaluating a potential claim.
Families may also face expenses related to the death. Medical bills incurred before the person died, funeral costs, and burial expenses may be relevant, depending on the circumstances and applicable law. Keeping bills, receipts, and payment records can help document these costs.
Beyond financial losses, a wrongful death claim may account for certain personal losses experienced by eligible surviving family members. The types of damages available and who may pursue them depend on the law and the facts of the case.
Insurance coverage may also need to be reviewed. Policies covering the vehicles involved, claim correspondence, medical records, and other available documentation can help clarify what coverage may apply. The amount of available insurance may affect how a potential claim is evaluated.
Evidence related to the crash can help establish what happened and whether another party may be responsible. Records from the investigation, photographs, witness accounts, and available video may provide information relevant to a legal review. Families may wish to preserve any documents they already have.
A wrongful death lawyer can review the available records, explain the legal options, and help eligible family members understand what steps may be available.
