A wrongful death claim after a pedestrian crash in Aiken County, SC, is generally evaluated by looking at the circumstances of the death, the surviving family's relationship to the deceased, and the losses resulting from the death.
These factors can help determine whether a claim may be available and what compensation could potentially be pursued.
The person's role within the family can be an important part of that evaluation. A household member may have provided income, services, or other forms of support that are no longer available. The financial effect of that loss can differ significantly from one family to another.
Funeral and burial expenses may provide another measure of the financial consequences. If medical treatment occurred before the death, those expenses may also become relevant. The circumstances and applicable law determine which losses may be included in a potential claim.
Beyond financial costs, the death of a family member can change the household in ways that are more difficult to quantify. Depending on the circumstances, certain losses related to the person's contributions to the family may be considered when a wrongful death claim is reviewed.
Insurance coverage may then become part of the evaluation. The vehicle's policy, available limits, and other applicable coverage can affect how a potential claim is addressed.
