Who Can File a Wrongful Death Claim After a Fatal Crash in Inman, SC?

Man Identified After Fatal Rollover on Hwy 176The personal representative of the deceased person’s estate files a South Carolina wrongful death claim for eligible surviving family members. South Carolina law generally allows spouses, children, parents, and other qualifying heirs to benefit from the claim. The family relationship determines who may receive any compensation.

After a fatal crash, families often need time to understand estate procedures and insurance issues. Funeral expenses, income records, medical documents, and insurance information help show financial losses. Keeping these records organized makes later discussions more productive.

Across Spartanburg County, Highway 176 connects with Interstate 26 and Interstate 85, carrying steady traffic daily. Serious crashes can leave families facing unexpected legal and financial concerns. South Carolina law provides a process for pursuing wrongful death claims.

Once the personal representative starts the claim, insurers may review crash evidence, witness statements, vehicle damage, and records. The representative files one claim for all eligible beneficiaries. This process keeps the case focused on the family’s overall losses.

Even when crash details seem clear, disputes over fault, insurance coverage, and damages may remain. A wrongful death claim may include funeral expenses, lost financial support, and other recognized losses. Available compensation depends on the evidence presented.

From there, a South Carolina wrongful death lawyer can gather records, communicate with insurers, and explain the state's wrongful death laws. An attorney can also identify the proper personal representative and important deadlines. Legal guidance helps families avoid confusion and make informed decisions.
