Yes. In South Carolina, a passenger hurt on a motorcycle can generally seek compensation from whoever's negligence caused the harm, which may include the motorcycle's operator, another driver, or another responsible party.
A passenger's claim is separate from the operator's, and a passenger is usually not blamed simply for riding along. Fault can still be examined in some circumstances, such as if a passenger knowingly got on with an impaired operator.
Insurance is usually where these claims get complicated. South Carolina drivers must carry liability coverage, with minimum bodily injury limits of $25,000 per person and $50,000 per accident, and serious injuries can exhaust those limits quickly.
Depending on the policies involved, a passenger may also look at medical payments coverage or underinsured motorist coverage, including policies held within the passenger's own household.
Passengers are commonly the closest witnesses to what happened, but their claims still need documentation. Medical records, photos of the road, and contact details for other witnesses can all matter.
South Carolina generally allows three years to file a personal injury lawsuit, though shorter deadlines can apply to claims that involve government entities. A motorcycle accident lawyer can help gather records, identify which parties and policies may be involved, and keep track of those deadlines.
