What Are the Legal Requirements for Motorcycle Injury Claims in Anderson, SC?

After a serious motorcycle collision in South Carolina, state statutes establish specific legal frameworks governing liability determination, statutory financial standards, and procedural deadlines for pursuing personal injury claims.

A modified comparative negligence framework governs operations in South Carolina. If a motorcyclist's share of the blame for the collision is less than 50%, they are entitled to monetary damages.

Any monetary compensation granted in cases where multiple drivers share responsibility is diminished proportionately by the plaintiff's assigned percentage of fault. It is legally prohibited for those found to be at least 51% at fault for the collision to sue other parties for damages.

South Carolina mandatory insurance laws also play a crucial role in post-crash recovery. All motor vehicle owners operating on public roadways must maintain liability coverage with statutory minimum limits of $25,000 for bodily injury per person, $50,000 for total bodily injury per accident, and $25,000 for property damage.

In addition, drivers must maintain uninsured motorist (UM) coverage to protect against hit-and-run drivers or motorists operating without insurance.

Strict procedural deadlines for filing a lawsuit are enforced by South Carolina law. Three years from the date of the incident is the standard statute of limitations for personal injury claims. The right to seek recovery is forfeited if formal legal proceedings are not filed within this time frame.
