No, not for every rider. South Carolina law only requires motorcyclists and passengers under age 21 to wear a helmet. Riders 21 and older may legally choose whether to wear one.
However, it is important to know that even where a helmet is not required, safety experts widely recommend wearing one to reduce the risk of a serious head injury while riding.
This is because motorcyclists generally face a higher risk of serious harm than occupants of enclosed vehicles. After all, they have far less physical protection. Common injuries include road rash, fractures, and head or neck trauma, even in relatively minor incidents. Recovery from these injuries can involve extended time away from work, physical therapy, and ongoing medical care.
South Carolina follows a modified comparative negligence rule, and state courts have generally declined to reduce compensation solely because a rider over 21 chose not to wear a helmet. Even so, insurance companies may still raise the issue when negotiating a claim.
A motorcycle accident lawyer can help a rider understand how these factors might affect a case and what evidence can support a claim.
