The pedestrian was injured in the collision and died at the scene. The drivers of all three vehicles were not injured.
The crash remains under investigation by the South Carolina Highway Patrol.
We extend our condolences to the family and loved ones of the person who lost their life during this difficult time.
Filing a wrongful death claim in Lexington County, SC, generally begins by determining who is legally eligible to bring the claim and identifying the party or parties who may be responsible.
The family should then gather relevant records, review the available evidence, and determine whether the claim should be filed within the applicable legal deadline.
Records related to the death can help establish the losses involved. Families may collect funeral and burial expenses, medical records, employment information, income records, insurance documents, and other financial information connected to the person's death.
Evidence from the fatal pedestrian crash may also be important when preparing a claim. Crash reports, photographs, witness statements, available video, vehicle damage, and roadway conditions may help establish how the pedestrian was struck and whether one or more drivers may have contributed to the crash.
Because three vehicles were involved in this collision, reviewing the actions of each driver may be necessary. Information about the sequence of impacts, vehicle positions, roadway conditions, and available evidence could help determine which parties may have legal responsibility.
Once the relevant information has been collected, an eligible family member can work with a wrongful death lawyer to evaluate the potential claim. The attorney may review the evidence, identify the appropriate parties, calculate documented losses, and handle communications related to the claim.
Timing is also important because wrongful death claims are subject to legal deadlines. Waiting too long to begin the process could affect whether a claim can be pursued, so families may benefit from reviewing their situation promptly.
