Under South Carolina law, the executor or administrator of the deceased person's estate brings the wrongful death claim. That person files the lawsuit on behalf of the relatives who qualify under state law.
Once a claim results in compensation, the money generally goes first to the surviving spouse and children. If no spouse or child survives, the parents may benefit. Other heirs may receive the recovery when none of those relatives survive.
Alongside the wrongful death claim, the estate may also have a survival claim. That claim can address losses the person experienced before death, including conscious pain or other damages the person could have pursued if they had lived.
As for timing, South Carolina generally allows three years to file a wrongful death lawsuit, so the personal representative must bring the case within that window. The clock usually starts on the date of death, although some circumstances can change the time available.
When questions come up about the estate, eligible family members, or different types of claims, a South Carolina wrongful death lawyer can explain who may bring the case and what compensation may be available. An attorney can also handle the paperwork required to move the claim forward.
