When accounts differ, crash reports, photographs, witness statements, and available video can help show how the collision happened. Investigators and insurers may use this evidence to determine what each driver was doing before the vehicles collided.
Because South Carolina follows an at-fault insurance system, an at-fault driver’s insurer may be responsible for losses that driver caused. A multi-vehicle claim can therefore involve several insurance companies reviewing responsibility at the same time.
As a passenger or driver hurt in the crash, compensation may cover medical bills, lost income, vehicle damage, and pain and suffering. The amount you may recover depends on your losses and how the collision has affected your work, finances, and daily life.
Punitive damages may also be available when a driver acted in an extremely dangerous way or knowingly ignored the safety of others. These damages are not available in every case and usually require stronger evidence than a standard negligence claim.
Under South Carolina’s modified comparative negligence rule, you may recover compensation if you are no more than 50% responsible for the crash. Your compensation is reduced by your share of fault, so the percentage assigned to you can affect how much you receive.
When insurance companies disagree about who caused the crash, a car accident lawyer can review the evidence and communicate with the insurance companies on your behalf. An attorney can also challenge unfair blame and help show which drivers were responsible.
