Comparative negligence can affect how much compensation an injured person may recover after a crash with entrapment in Horry County, SC. South Carolina follows a modified comparative negligence rule, meaning an injured person’s recovery can be reduced based on their percentage of fault. If the injured person is found 51% or more at fault, recovery is generally barred.
For example, if an injured person has $100,000 in damages and is found 20% responsible for the crash, the potential recovery could be reduced to $80,000. When multiple parties may have contributed to the injuries, South Carolina law allows fault to be apportioned among the defendants and other potentially responsible parties.
Evidence can be especially important when a person becomes trapped inside a vehicle after a crash. Crash reports, photographs, vehicle damage, witness statements, available video footage, roadway conditions, and other records may help establish how the collision occurred and which parties may have contributed to the injuries.
A person injured in an Horry County crash should understand how comparative negligence could affect a potential personal injury claim. The circumstances surrounding the entrapment and the conduct of each involved party may be relevant when determining responsibility and potential compensation.
