Families may be able to seek compensation for funeral and burial expenses, lost financial support, loss of companionship, and emotional harm after a fatal crash in Anderson County. In some cases, additional damages may also be available based on the circumstances surrounding the death.
In South Carolina, a wrongful death claim benefits certain surviving family members. A surviving spouse and children generally have priority, followed by the deceased person’s parents when there is no spouse or child, and then other heirs when applicable.
Because relatives generally do not bring separate wrongful death actions, the deceased person’s executor or administrator files the case on behalf of those entitled to recover. This keeps the family’s wrongful death claim within one legal action.
If the parties reach a settlement, South Carolina requires court approval before it becomes final. Depending on whether a lawsuit has already been filed, a probate court, circuit court, or federal district court may review the proposed agreement.
Once compensation is recovered, the money is distributed among the appropriate beneficiaries according to the shares that would apply if the deceased person had died without a will. The final distribution therefore depends on the family relationships involved.
As the claim moves forward, a South Carolina wrongful death attorney can review the circumstances of the fatal crash and determine what compensation the family may have grounds to pursue. A lawyer can also handle discussions with the insurance companies involved.
