In a wrong-way crash, a lawyer handles several complex aspects of your case. They focus on finding out why a driver was on the wrong side of the road, whether due to poor signage, intoxication, or distraction, and manage the complex legal steps required to hold the responsible parties accountable.
Wrong-way accidents are rarely simple mistakes. A lawyer investigates the root cause, such as whether the driver was under the influence, fatigued, or misled by confusing road markings or missing "Do Not Enter" signs.
By securing toxicological reports and analyzing the at-fault driver's actions leading up to the crash, a lawyer builds a clear picture of negligence that is necessary for a successful wrongful death claim.
South Carolina law requires a specific legal process to begin a claim after a death. A lawyer helps the family navigate the probate court to appoint a "Personal Representative," who is the only person legally authorized to file a lawsuit on behalf of the deceased. This step is key to ensuring the case moves forward correctly and that any eventual settlement is distributed fairly among the surviving family members.
Following a high-profile fatal crash, insurance companies often try to settle quickly to limit their financial risk. A lawyer provides great support at that stage, handling all communications and preventing the family from being pressured into a low-ball settlement during a time of grief.
