What can I do if I've lost a family member in a scooter accident in South Carolina?

Accidents involving electric scooters involve different right-of-way rules and often lack the insurance protections of a standard car. Your priority should be ensuring a detailed police report is filed and seeking legal help to identify which insurance policies, whether auto or homeowners, might apply to your situation.

When the local police are investigating, an official report will be filed. This document is critical because it will note the specific points of impact and any witness statements regarding traffic signals or stop signs at the location of the accident. Having this report is the first step in ensuring the facts are documented accurately before memory fades.

In scooter accidents, the condition of the scooter itself can provide vital clues. Do not repair or discard the scooter. A professional can examine the electric scooter for mechanical failures or analyze the damage patterns to determine the angle of impact.

Similarly, if there were any electronic logs or GPS data on the scooter, that information needs to be preserved immediately.

Electric scooters often fall into a "gray area" of insurance. A lawyer can help determine if the driver’s auto insurance applies or if the victim’s own insurance policies provide coverage for "uninsured" incidents.

They will also look into the other driver’s policy to ensure that the limits are sufficient to cover the immense medical and funeral costs associated with a fatal crash.

By contacting a lawyer, you gain an advocate who understands South Carolina’s specific traffic laws regarding small electric vehicles. A lawyer can handle the high-stress communications with adjusters and work with reconstruction experts to prove exactly how the collision occurred.
